The reason metallica is sueing napster is becuase they had the song I Disappear out to millions of people before it was ever officially released. Also since the internet sales for bigger bands have been on the rise. If you've only got a few good songs out there then your band will pretty much get destroyed becuase noone will by your cd when they can just download the music right off of the internet. Mp3's are ILLEGAL unless you own the cd. Napster made it possible for millions of people to have a song not even released yet so there is no way anyone could have it legally yet which will kill record sales for metallica's new album. Metallica is a band who can afford to take the loss in sales which is why they have to be the ones to sue napster. anyone smaller couldn't take the loss and the band would go under. It was bound to happen sooner or later anyway. Napster is finally going to be taken off the web which it needs to be.
